1.2 Customer or Sold-To Party:
All who use the webshop services, i.e. have registered on the web-interface of Moonbirdshirts.com, order and buy goods or services via this interface.
1.3 Shippers’ Data:
1.3.1 Magyar Posta Zrt. (referred to as Magyar Posta Zrt.)
Magyar Posta Zrt. (Hungarian Post) delivers our goods on the basis of its own General Terms of Delivery, at prices available in Business Code and under Support.
2. Objective of the Terms of Webshop Services:
Moonbirdshirts.com has published its Terms of Services in order to control the conditions of the webshop services and their use, rights and obligations of the Service Provider and the Customer, and other circumstances related to the webshop services.
Terms of Webshop Services describe the general conditions of the relationship between Moonbirdshirts.com and the Customer entering a contract with it. All issues not contained here are governed - without special stipulation - by the valid version of Hungarian law and authority prescriptions as well as provisions of the Civil Code concerning webshop activity of the Service Provider.
2.1 Publishing the Terms of Webshop Services
Acceptance of the Terms of Services of the webshop is precondition of the use of webshop services. Use of the services by the Customer, i.e. her/his registration is deemed as acceptance of the Terms. If the Terms of Webshop Services have changed since the last login, the Customer is notified when logging in, and the Customer has to accept them again prior to placing the next order.
2.2 Effectiveness of the Terms of Webshop Services:
Moonbird.hu reserves the right to modify the Terms of Webshop Services completely or partially at any time. The Terms of Webshop Services and their modifications come into force at the time of their publication. Terms of Webshop Services are valid until the Webshop Service Provider assures the webshop services.
3. Webshop Services:
Moonbird.hu provides the Customer the webshop services under the following conditions.
3.1 Territorial Effectiveness of the Webshop Services:
The data network interface maintained by the Webshop Service Provider is accessible both from Hungary and from abroad due to the features of the data network (Internet). Moonbirdshirts.com accepts orders from any country of the world.
3.2 Data Required for Registration:

After registration, a confirmation will be sent by e-mail to the e-mail address supplied where the user can validate her/his account.

3.4 About storage of the data listed above, Moonbirdshirts.com makes the following declaration:
Moonbirdshirts.com has been commissioned with storage, archiving and handling the data, and is ready to handle data confidentially. Moonbirdshirts.com will not disclose them to any third party, will store them safely and securely on its servers, at the availability time defined by Moonbirdshirts.com in a freely viewable way. Safe and secure storage means a database with files that cannot be browsed freely, is protected by adequate passwords and accessible only locally.
4. Create and Change the Webshop Contract:
4.1 General:
The Contract will be created by your registration on the web-interface of the Service Provider, by accepting these Terms of Services. The registration is the precondition of purchases in the webshop. Orders are created when Customers validate their orders in their final form. When the authenticity of registration data is questionable or they cannot be interpreted, Moonbirdshirts.com reserves the right to cancel such data and invalidate the orders placed with such data.
4.2 Registration:
Having supplied her/his data during webshop registration, the Customer is enabled to place orders. Customers can select goods freely from the product choice and put them into their carts. Customers can log in the store by supplying their user names and passwords. Products put into the cart without logging in will be automatically placed into the individual cart of the Customer when she/he logs in.
4.3 Change and Cancel Orders:
In sense of the Act No. CVIII/2001, when submitting an order, the Customer automatically obtains a notification about acceptance of the order. If it is not received by the Sold-To Party within 48 hours, the Sold-To Party is not bound by the quotation any more. Moonbirdshirts.com provides the Sold-To Party the opportunity to cancel her/his order electronically up to beginning the fulfilment of the order. When fulfilment of the order begins, the Sold-To Party receives a notification about the expected duration of the fulfilment and about the fact of beginning the fulfilment, afterwards the order can only be cancelled by e-mail or phone within 8 hours from the time of the order.
When selecting "Personal Goods Receipt", the Customer is notified about the availability of the goods. If the Customer does not take measures to take over the goods within 14 days after receipt of this notification, the order will be cancelled.
4.4 Terms of Payment:
Customer pays the value of the service either electronically (PayPal) when submitting an order or in cash to the deliveryman on receipt of the goods. The deliveryman gives an invoice about receipt of cash. Moonbird.hu does not fulfil orders partially, and the deliveryman shall not accept partial fulfilment. The Customer can either accept all items of the order completely or reject the acceptance of the complete order. If the Sold-To Party refuses to take over the goods ordered, Moonbirdshirts.com reserves the right to cancel her/his registration and, at its individual discretion, invalidate her/his orders placed in the meantime, if any.
4.5 Failed Delivery:
In the case of general delivery time, the deliveryman tries to hand over the ordered goods three times. Afterwards the Seller declares the order invalid and cancels it. In the case of "Personal Goods Receipt", the Seller keeps the ordered goods reserved for the Sold-To Party for 8 days. Afterwards, the Seller declares the order invalid and cancels it.

5. Rights and Obligations of the Customer:
5.1 Right to Abandon
Customer has the right to return the goods to the Service Provider completely within 8 days. On the basis of the government decree no. 17/1999. (II. 5.) about Contracts between remote parties, costs of return are to be born by the Customer. To avoid contentious issues, the Seller takes a video record about opening the parcel containing returned goods. The Seller shall send back the price to the Customer of the goods within 30 days from receipt of the parcel. The 8-workday period for abandoning begins on the day of goods receipt by the Customer.
5.2 Potential Damages of Moonbird.hu
In accordance with the above mentioned decree, if the returned goods prove to be damaged, and this damage originates from their use against the rules, Moonbird.hu may request the Sold-To Party to refund the value loss caused in the products.
5.3 Warranty
The Seller provides warranty of 6 months for the goods sold. For the warranty and guarantee liability of the Seller, the provisions of the Civil Code and the government decree No. 117/1991. (IX.10.) are valid.
6. Data protection and data security:
6.1 Privacy Statement:
During registration necessary for using the services, Moonbirdshirts.com collects the following data of the customers: identification data of the customer: user name, password (encrypted in one way) and e-mail address, name, address and phone number of the Customer. For the delivery of the goods ordered, Moonbirdshirts.com makes the following data available for the delivery company or its agent: date of order, name of Ship-To Party (from delivery address), company name (from delivery address), full delivery address, order total, order number, phone number and other contact data of the Sold-To Party.
6.2 Change Personal Data:
Customers can change and cancel their personal data, excluding the following data, on the webshop user interface at any time:

7. Final Provisions
7.1. Stipulations Concerning Contract between Remote Parties
No written contract will be created with these terms and filed by Moonbirdshirts.com. Exceptions from this rule may be our customers that do most of their purchase transactions non-electronically.
7.2. Related Documents
Rights and liabilities of this contract are valid with the provisions of the document “Terms of Designers’ Participation” that the Parties accept as bounding for themselves.
Customers may request the termination of the contract at any time. Having identified the customer, we acknowledge the termination, and stop webshop access of the user.
In the case of non-adequate behaviour of a Customer, Moonbirdshirts.com reserves the right to quit the contract unilaterally, if justified.
7.5. Exclusion of Liability of Moonbirdshirts.com
For misuse caused by negligence of the user (such as disclosure of password to third parties), no financial and/or moral liability is taken. Contentious issues are considered on the basis of the data recorded and archived digitally, making their relevant details available for the Customer upon Customer’s request.
